Mr. Duke violated my civil rights. In 1999, I was charged with armed robbery. I had NEVER been in trouble with the law in my life. During my Pre-Sentence Investigation Report (PSIR) I informed Mr. Duke about my history with brain cancer (a type of cancer with a high rate of recurrence) but Mr. Duke sat on the information. He should have called the prosecuting attorney's office and provided that information but didn't. It turns out, about 24 months into the prison sentence, they found another massive brain tumor inside my right temporal lobe. The right temporal lobe controls/regulates 1. Personality, 2. emotions, 3. some behavior, 4. memory, and other things.

My neurosurgeon and neurologist both believed the brain tumor was the reason behind the action, but Mr. Duke hung me out to dry. By the time I could sue him for violating my Sixth Amendment right the statute of limitations prohibited me from doing so.

Mr. Duke is lazy, inept, concomitant and should be disbarred. He chronically walks into court looking like an alcoholic just coming off a binge or someone who just rolled out of bed. In essence, completely unprofessional.

I would not recommend Mr. Dani...

I would not recommend Mr. Daniel Duke to anyone. He has been unprofessional in the area of communications with me, his client. I have made repeated phone calls, first asking nicely, then begging, and finally demanding a return phone call with no results. My case should be looked upon as seriously as any other. He avoids questions and seems to only care about getting paid by the county/state, with no regard to his clients and their actual case and it's history. My question is simple and he couldn't be bothered to call me and discuss it. Mr. Duke is a "yes" man for the courts of Midland County. He has no guts or integrity.
