My actions are subsequent of the unfair or deceptive events as follows:

On Oct 15, 2011, knowing nothing about transmissions I relied entirely on you the owner (Victor Elliot) expertise thus resulting into an agreement (1 week) to fix my 2006 Nissan Pathfinder which would include a warranty of 20,000 miles. Based on your estimations I made rental arrangements to provide a mode of transportation during the repair time. When towing my truck I gave you $800 down per your request. A week later I made necessary preparation to drop off the rental car and pick up my truck; however, I was informed by you that my tuck was not ready. In fact, I soon find out that you over promised and under delivered - you made numerous erroneous promises at different dates and times over a 30 days span. As a direct result, of your continual broken promises - YOU agreed to subtract some of the rental car fees from the remaining balance.



On Nov 12, 2011, I was informed that my truck was ready for pick up. To my surprise you the owner would only accept the full balance to get my car - $1600 not a penny less, in fact anything you previously stated was not honored. You didn’t care about my additional rental car fees or any other agreements you may had stated. In actual fact, you made the statement that “Everyone is having hard times and besides you have to pay your employees”. I was deeply troubled by your statement – you were very insensitive to what your actions had forced upon me. I stated to you “One situation didn’t have anything to do with the other; in reality it had more to do with your inability to properly diagnose and fix the problem, but you kept trying anyway”. I tried gracefully to talk to you – to no end no resolution came; in fact you stated to me “What do I want you to do?” With no resolution I gave you the entire reminding balance and was going to make plans to deal with the difference in court. The only request was that I test drive my truck before money was exchanged. You stated “That the dealership don’t let you test drive before you pay, and you don’t either”. Well, Money and keys (you threw across your desk and ended on the floor) were exchanged after a few choice words were exchange between you and my boyfriend as your two nephews entered the establishment as if we were about to get jumped.



We immediately left, before I got on the freeway approximately a mile (3 minutes) from you facility my check engine light came on. I continue to drive, and made a couple of stops before heading home – listening very closely to the transmission shifting. Well the next morning, Nov 13 on my way to church my tuck made a loud noise. I pull into the church premises and it appeared to be back normally. I dropped off my nieces and nephews and it started again. My truck would no longer shift into first gear. I travel the back way home - approximately 20 miles to stay off the freeway attempting to not force my truck to shift. You were immediately informed that night about the event that transpired. You did indicate I could bring my truck back, however under the circumstances it is not in my best interest – the relationship/trust has been tainted.
