It is unfortunate that this tenant did not get his deposit back as he wished. His unit had water damage that he either caused through misuse or neglected to take care of or report. It is clear in his lease and the law following the lease that he should report damage as it occurs to prevent further damage or he will be responsible for damages. He also did not steam clean the carpet until he moved out and had high traffic from pets and children. There were significant marks on the walls that were not normal wear and tear of which he sloppily attempted to cover with the wrong shade of paint. There were also major stains on the carpet. He did have a pet. He was given information on how to clean and paint correctly ahead of time and given opportunity to re-paint and re-clean to correctly to reduce his cost, but he chose not to do so. He was only charged $100 for carpet stains, when the carpet needed to be replaced. Also, 3 blinds needed to be replaced that he was not charged for. As a new tenant, you would not accept the condition of the unit as is and therefore it needed to be cleaned and repaired. As a property owner you should ask for references and stay away from tenants who will not take proper care of your property.
