Workers Compensation

North Dakota Workforce Safety and Insurance is an insurance company without any competition or real oversight or regulation. WSI’s headquarters building is bulletproofed— for a very good reason. WSI employees find it necessary to protect themselves from the very people they claim to be helping. WSI uses nearly a dozen attorneys to help it deal with disgruntled injured workers and small employers who don’t think they’ve been given a fair shake. They also retain private investigators around the state to spy on injured workers and their families as well as struggling small businesses. Finally, WSI hires as many “opinion mill” doctors as they need to in order to refute the opinions of North Dakota treating doctors. All this is done solely in an effort to deny benefits.

Under current state law, WSI will pay an injured worker’s attorneys fees, up to a $500 maximum, for reviewing proposed settlements and for an in-depth review of a claims file after WSI’s Decision Review Office has approved WSI’s denial of benefits. WSI will also pay attorney’s fees if an injured worker wins at a formal, administrative hearing.

Social Security Disability

The SSD system is quite lengthy and very complex. It’s important to have an experienced attorney guide you through this process. Currently, there is about a 14-month delay in being provided a hearing. The Social Security Administration allows recipients’ attorneys to obtain a fee equal to 25% of any back due disability benefits. Monthly benefits are not subject to attorney’s fees. All fee agreements are in writing.
