Tow truck rules and regulations are strictly enforced at the municipal government level. At the state level, laws regulate predatory towing service practices to prevent high tow and storage charges.
Florida has laws regulating the towing of vehicles and vessels, such as motorboats. The laws generally come into play when vehicles or vessels are parked illegally on private property or are parked in areas plainly marked as "No Parking zone" or "Tow-Away Zones." State laws govern how far a vehicle or vessel can be towed, when the owner can retrieve it and more.
Towing Radius
Florida Statute 715.07 regulates the towing--and storage--of vehicles and vessels. According to the statute, any towed or removed vehicle or vessel must be stored within a 10-mile radius of the point of removal in any county with a population of .5 million people or more and within a 15-mile radius of the point of removal in any county with a population of less than less than .5 million Under certain conditions, the vehicle or vessel can be stored up to 30 miles away.
Access Hours
The towing company's storage site must be open from 8:00 a.m. to 6:00 p.m. on any day the towing company is open for towing services. The hours are necessary to allow owners to claim their vehicles or vessels. When closed, the towing company must display a sign with the telephone number of a company representative who can be reached at all times. Upon being called the company representative must return to the site within one hour.
Notifying Police
The municipal police department or sheriff must be notified by the towing company representative within 30 minutes of the towing or removal taking place. A description of the vehicle must be left with the police or sheriff, including the make, model, color and license plate number. Vessels that are towed or removed must be reported by their registration number and color.
Business Owners
A business owner may authorize the removal of a vehicle or vessel if it is parked in a manner restricting the normal operation of business--even if there is not a posted tow-away zone sign. However, designated tow-away zone areas must be marked with a tow-away zone sign.
